Delhi MCD polls: court orders EVMs sealed after BJP wins ward by two votes
A Delhi court on Monday ordered the State Election Commission to keep the electronic voting machines used in a south Delhi ward during the recent municipal polls sealed and untouched. The order came on a petition challenging a BJP candidate’s win by just two votes.
The disputed result
The petitioner, AAP candidate Pinky Tyagi, lost to BJP candidate Anita Tanwar in ward number 70-S, Chhattarpur. Tyagi polled 8,413 votes and Tanwar 8,415.
District and Sessions Judge Asha Menon asked the poll panel to file its response to the plea by May 19.
What the court ordered
Advocate Gopal Jha, representing Tyagi, said the court also told the commission to preserve, until further orders, the register signed by voters and any record of voter slips handed in before polling, so that the material could not be tampered with.
The court did not accept Tyagi’s request to stop Tanwar from being sworn in as councillor, and it refused to stop the South Delhi Municipal Council from going ahead with the swearing-in.
Background
The case is one of the disputes that followed the municipal elections in the capital, where the margin in this ward was among the narrowest possible.
